These Terms of Service (“Terms”) govern your access to and use of ogkdiamondpainting.com and your purchase or use of products and services offered by OgK Diamond Painting and Accessories LLC, doing business as OGK Diamond Painting (“OGK,” “we,” “us,” or “our”).

By visiting our website, placing an order, creating an account, communicating with us regarding an order, or otherwise using our services, you agree to these Terms and to the other policies referenced in them.

Our store is hosted by Shopify, which provides the ecommerce platform we use to offer our products and services.

1. Online Store Terms

You must be at least the age of majority in your state or jurisdiction of residence to make a purchase from our store, or you must have the permission and supervision of a parent or legal guardian.

You may not use our website, products, services, or content for any unlawful or unauthorized purpose or in violation of any applicable law.

You must not transmit viruses, malware, malicious code, automated attacks, or any other material intended to interfere with the operation or security of our website or services.

We may refuse, restrict, suspend, or terminate access to our services when reasonably necessary to protect OGK, our customers, Shopify, or others.

2. Our Products

OGK specializes in diamond painting accessories and related products, including 3D-printed items, handmade products, tools, organizers, trays, pen accessories, caddies, stands, decorative items, and other products offered through our store.

Many OGK products are made to order, 3D printed, handmade, or produced in small batches.

Because of the nature of these manufacturing methods, minor variations may occur between products. These variations can include:

• Layer lines or other normal characteristics of 3D printing

• Minor differences in dimensions or surface texture

• Small variations in handmade finishes

• Differences in filament sheen or appearance

• Differences between filament production batches

• Slight variations in multicolor or rainbow filament transitions

• Minor differences between product photographs and the item received

These characteristics are normal and are not considered defects when they do not materially affect the intended function of the product.

3. Product Colors, Photos and Dimensions

We make reasonable efforts to display product photographs, colors, finishes, measurements, and descriptions accurately.

However, colors may appear differently depending on your monitor, phone, tablet, lighting conditions, filament batch, print orientation, and other factors outside our control.

Rainbow and multicolor filaments are especially variable. The exact portion of a color gradient that appears on an individual product cannot always be predicted or duplicated.

Unless otherwise stated, dimensions listed on product pages are approximate. Small dimensional variations are normal for 3D-printed and handmade products.

Customers are responsible for reviewing product descriptions, dimensions, compatibility information, color selections, and other available product information before placing an order.

4. Made-to-Order Products and Final Sales

Most OGK products are produced specifically for the customer after an order is placed.

Because products are made to order, all sales are final except as described in our Return & Refund Policy or as otherwise required by applicable law.

We do not accept returns or exchanges simply because a customer changes their mind after placing an order.

An order should not be considered canceled unless OGK has expressly confirmed the cancellation.

Our Return & Refund Policy is incorporated into these Terms by reference and controls questions concerning damaged, defective, incorrect, returned, or credited merchandise.

5. Quality Guarantee

We inspect and securely pack our products before shipment.

If an item arrives damaged, defective, or incorrect, contact us within the period stated in our Return & Refund Policy and provide the requested information, which may include:

• Your order number

• Clear photographs of the product

• Photographs of the packaging when relevant

• A description of the problem

Once we confirm the issue, the appropriate resolution may include a replacement product, replacement component, or OGK store credit.

Normal characteristics of 3D printing or handmade production described elsewhere in these Terms are not considered defects unless they materially interfere with the intended use of the product.

6. Store Credit

When OGK approves store credit as a resolution, the credit is issued for use with OGK Diamond Painting.

Store credit:

• Is not redeemable for cash except where required by law

• May only be used for eligible purchases from OGK

• Is subject to Shopify's technical and account requirements

• May be tied to the customer account or email address to which it was issued

Store credit issued as a customer-service resolution does not create an entitlement to a cash refund unless applicable law requires otherwise.

7. Orders and Order Acceptance

Submitting an order does not require OGK to accept or fulfill the order in every circumstance.

We reserve the right to refuse or cancel an order for legitimate business reasons, including:

• Suspected fraud or unauthorized payment

• Pricing or listing errors

• Product availability problems

• Technical errors

• Abusive or fraudulent activity

• Unusually large quantities

• Orders that appear intended for unauthorized commercial reproduction or resale

• Orders we cannot legally fulfill

• Circumstances that make fulfillment impractical or impossible

If we cancel an order after payment has been collected, we will provide the appropriate refund or payment reversal for the canceled portion.

We may limit quantities purchased by a single customer, household, account, payment method, or address when reasonably necessary.

8. Pricing and Payment

Prices are displayed in the currency shown by our store and may change without notice.

The price applicable to an order is generally the price shown at checkout when the order is submitted, subject to correction of obvious errors.

We reserve the right to correct typographical, pricing, promotional, inventory, or technical errors.

If a material pricing error is discovered after an order is placed, we may contact you to resolve the issue or cancel and refund the affected item or order.

You agree to provide accurate and current billing, payment, shipping, and contact information.

You represent that you are authorized to use any payment method submitted for a purchase.

Payment processing may be performed by Shopify or other third-party payment providers and may be subject to their additional terms and privacy practices.

9. Shipping and Delivery

Our Shipping Policy is incorporated into these Terms by reference.

OGK products are made to order, and current production and shipping expectations are stated in our Shipping Policy and, where applicable, on individual product pages.

Customers are responsible for providing a complete and accurate shipping address.

If you discover an address error, contact us as soon as possible. We will attempt to help before shipment, but we cannot guarantee that an address can be changed after an order has entered production or shipment processing.

If a package is returned because of an incorrect or incomplete address supplied by the customer, a reshipment fee may apply as described in our Shipping Policy.

Carrier transit times and delivery dates are estimates. OGK is not responsible for carrier delays caused by weather, holidays, transportation disruptions, carrier volume, natural disasters, or other circumstances outside our reasonable control.

10. Product Use and Safety

Products should be used only for their intended purpose.

Customers are responsible for following any care, compatibility, installation, handling, or safety information included with a product or its listing.

Unless a product is specifically identified as intended for children, OGK products should not be assumed to be children's toys.

Small parts may present a choking hazard. Keep products containing small components away from young children and pets where appropriate.

OGK is not responsible for damage caused by misuse, improper storage, unauthorized modification, excessive force, exposure to inappropriate temperatures, or use of a product for a purpose for which it was not designed.

11. Custom Requests and Customer-Supplied Materials

OGK may choose to accept custom requests, personalized products, special colors, or customer-supplied concepts or reference materials.

We reserve the right to decline any custom request.

When you provide artwork, photographs, logos, text, graphics, characters, files, or other materials for use in a custom order, you represent that you have the right to provide and authorize our use of those materials for the requested purpose.

You are responsible for claims arising from materials you supply if those materials infringe another person's copyright, trademark, privacy, publicity, or other legal rights.

Providing a general idea or requesting a custom product does not automatically create exclusivity over a product concept, manufacturing method, functional feature, color combination, or independently developed OGK design.

Unless otherwise agreed in writing, OGK does not claim ownership of a customer's pre-existing copyrighted artwork or other pre-existing intellectual property merely because it was supplied for a custom order.

12. OGK Intellectual Property

The OGK website and the original materials created by OGK are protected by applicable intellectual-property laws.

This includes, where applicable:

• Original product designs

• Original 3D models and model geometry

• CAD and digital design files

• Product modifications and original design elements

• Photographs

• Graphics

• Logos and branding

• Website text

• Product descriptions

• Promotional materials

• Videos

• Instructions

• Artwork

• Layouts and other original content

Purchasing a physical OGK product transfers ownership of that particular physical item to you. It does not transfer ownership of OGK's underlying intellectual property or grant a license to commercially reproduce an OGK design.

Unless we give written permission, you may not copy, reproduce, distribute, sell, license, upload, publish, commercially manufacture, or distribute OGK-owned digital design files or protected content.

You may not obtain, reproduce, or distribute OGK digital design files through unauthorized means.

You may not use OGK product photographs, descriptions, graphics, branding, or other protected materials to falsely represent another product or business as being produced, authorized, or affiliated with OGK.

Nothing in these Terms is intended to claim rights that OGK does not legally own or to restrict lawful uses that cannot legally be prohibited.

13. Website Content

Website content is provided for shopping, product information, customer support, and general informational purposes.

We work to keep information accurate and current, but occasional typographical errors, outdated information, technical mistakes, or omissions may occur.

We may update product descriptions, photographs, prices, availability, measurements, policies, or other website content when appropriate.

Historical content may remain available for reference and should not necessarily be interpreted as current information.

14. Reviews, Comments and Customer Content

If you submit a product review, comment, photograph, testimonial, suggestion, feedback, or other content to OGK through our website or at our request, you represent that you have the right to submit that content.

You may not submit content that:

• Infringes another person's rights

• Contains malware or malicious code

• Is fraudulent or intentionally misleading

• Is unlawful

• Impersonates another person

• Contains another person's private information without authorization

When you voluntarily submit content specifically for publication or promotional use by OGK, you grant us a non-exclusive, royalty-free license to display, reproduce, and use that content for the purpose for which it was submitted, subject to applicable law.

We may remove website content or reviews when permitted by law and applicable platform rules.

15. Third-Party Services and Links

Our website and services may interact with third-party services, including Shopify, payment processors, shipping carriers, review providers, social networks, and other service providers.

Third-party websites and services operate under their own terms and privacy practices.

OGK is not responsible for the independent content, security, availability, policies, or conduct of third-party websites or services that we do not control.

A link to a third-party website does not necessarily constitute OGK's endorsement of everything offered or stated on that website.

Your personal information is handled according to our Privacy Policy, which is incorporated into these Terms by reference.

Our Privacy Policy explains the types of information we collect, how we use and disclose that information, the service providers involved in operating our store, and rights that may be available to you under applicable privacy laws.

17. Prohibited Uses

You may not use our website or services:

• For unlawful purposes

• To violate applicable laws or regulations

• To infringe our intellectual-property rights or those of others

Shopify, payment systems, internet providers, hosting services, carriers, utilities, and other third-party systems can experience outages, maintenance periods, or technical problems outside OGK's control.

We may modify, suspend, discontinue, or replace features of our website or services when reasonably necessary.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website and services are provided on an “as available” basis.

We do not warrant that the website will be uninterrupted or completely free from errors, security vulnerabilities, or other technical problems.

Products are subject to the specific descriptions, quality guarantees, and policies provided by OGK.

Nothing in these Terms excludes any warranty, consumer protection, or other right that cannot legally be excluded or limited.

20. Limitation of Liability

To the fullest extent permitted by applicable law, OgK Diamond Painting and Accessories LLC and its owners, employees, contractors, representatives, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of our website, services, or products.

Where permitted by law, OGK's total liability for a claim concerning a purchased product will not exceed the amount paid to OGK for the product giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited.

Nothing in these Terms limits rights or remedies provided by law that cannot be waived.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless OgK Diamond Painting and Accessories LLC from third-party claims, damages, liabilities, and reasonable costs resulting from:

• Your unlawful use of our website or services

• Your material violation of these Terms

• Your infringement of another person's intellectual-property or other rights

• Materials you provide for a custom order when you did not have the legal right to provide or authorize their use

This provision does not require you to indemnify OGK for liability caused solely by OGK's own unlawful conduct where such an obligation would be prohibited by law.

22. Events Outside Our Control

OGK is not responsible for delays or failure to perform caused by events outside our reasonable control.

These events may include severe weather, natural disasters, fire, flood, power outages, internet or telecommunications failures, equipment failures, supply shortages, carrier disruptions, labor disruptions, government actions, civil emergencies, or other comparable events.

When such an event affects an order, we will make reasonable efforts to resume normal operations and fulfill affected orders.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

24. No Waiver

If OGK does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

A waiver of one violation does not constitute a waiver of another violation.

25. Entire Agreement and Other Store Policies

These Terms, together with the policies and rules posted on our website and incorporated by reference, constitute the agreement governing your use of our store and services.

• Individual product descriptions and disclosed product-specific conditions

If a product-specific term directly conflicts with a general provision of these Terms, the more specific product term will control for that product unless prohibited by law.

These Terms and transactions with OGK are governed by the laws of the State of Oklahoma and applicable United States federal law, without regard to conflict-of-law principles, except where the law of your jurisdiction provides rights that cannot legally be waived.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, business practices, technology, or legal requirements.

The current version will be posted on our website with an updated effective date.

Changes apply prospectively except where a different application is required or permitted by law.
